Terms of Use & Community Policies
KimoKawaii Anime Experience & Convention is operated by Silverback Events LLC in Conroe, Texas. These terms apply to kimokawaii.net, the KimoKawaii member platform, ticketing, events, online community features, vendors, artists, sponsors, guests, volunteers, staff, and attendees. By using the website, creating an account, purchasing a ticket, applying as a vendor or artist, attending an event, uploading content, or participating in the KimoKawaii community, you agree to follow these terms.
Acceptance of Terms
By accessing or using kimokawaii.net, creating a member account, purchasing tickets, submitting an application, participating in KimoKawaii events, uploading content, checking an acknowledgment box, or otherwise using any KimoKawaii services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, our Privacy Policy, and all applicable KimoKawaii policies. Where permitted by law, your electronic acceptance has the same legal effect as a handwritten signature.
1. Eligibility
You must be 16 or older to create a member account. Members under 18 require verifiable parental or guardian consent. KimoKawaii does not knowingly allow children under 13 to create accounts or submit personal information. Accounts found to belong to users under 13 will be deleted within 72 hours of discovery. We reserve the right to verify age and terminate accounts that do not meet eligibility requirements.
2. Minor Safety
KimoKawaii strongly recommends that members under 18 not share personal contact information, home addresses, school information, private social media accounts, or arrange to meet other members in person without the knowledge and consent of a parent or legal guardian.
Using the platform to contact, solicit, groom, or engage in predatory behavior toward minors is grounds for immediate permanent ban and may be reported to law enforcement. Parents and legal guardians are responsible for the conduct, safety, and online activity of minors in their care.
3. Community Code of Conduct
KimoKawaii exists to build a welcoming, creative, family-friendly anime and pop culture community. All members, attendees, vendors, artists, guests, volunteers, and staff are expected to treat others with respect.
The following behavior is not allowed:
Harassment, bullying, stalking, intimidation, threats, or hostile behavior toward any person
Hateful, discriminatory, or degrading language targeting any individual or group
Unwanted physical contact, including touching someone's costume, hair, body, or props without permission
Sexual harassment, unwanted flirting, catcalling, sexual comments, or continued contact after someone asks you to stop
Following, photographing, recording, or approaching someone after they have declined contact
Doxxing, sharing private information, impersonation, or encouraging others to harass someone
Disruptive behavior, heckling, blocking walkways, interfering with programming, or creating unsafe conditions
Harassment is determined by the experience of the person receiving the behavior, not the intent of the person doing it. If someone asks you to stop, leave them alone, or give them space, you must do so immediately.
Cosplayers are people first. Always ask before taking close-up photos, touching costumes, posing with someone, or interacting with props.
4. Online Community Rules
The KimoKawaii platform includes member profiles, direct messaging, photo walls, friend connections, cosplay tools, event attendance features, and community directories. Members must use these features responsibly.
Do not use profiles, messages, photos, tags, or friend requests to harass, threaten, bully, spam, impersonate, manipulate, or pressure other users
Do not upload illegal, hateful, sexually explicit, exploitative, violent, stolen, or misleading content
Do not upload or share private photos of others without their permission
Do not use the platform to solicit minors, request inappropriate photos, or engage in predatory behavior
Do not create fake accounts, evade bans, scrape member information, or misuse the directory
Do not use the community to promote scams, unauthorized sales, pirated goods, counterfeit goods, or outside promotions without written permission
KimoKawaii may review, moderate, restrict, remove, or approve content at its discretion. Moderation is not censorship. It is how we protect the health, safety, and culture of this community.
5. Direct Messages
Direct messages on the KimoKawaii platform are subject to our community policies. KimoKawaii may review direct messages in response to reports of harassment, abuse, predatory behavior, threats, or violations of these terms. Using direct messages to harass, threaten, solicit, or engage in inappropriate contact with any member, especially minors, is grounds for immediate permanent ban. KimoKawaii is not responsible for unsolicited messages but takes all reports seriously and will act on them.
6. Account Responsibility and Suspension
You are responsible for maintaining the security of your account. Silverback Events LLC is not liable for unauthorized access resulting from your failure to secure your credentials.
KimoKawaii may suspend, restrict, or permanently terminate accounts for violations of these policies, unsafe behavior, fraud, harassment, chargebacks, abuse of platform features, or conduct that harms the community. Creating a new account to evade a suspension or ban is itself a permanent bannable offense. Suspended or banned users who attempt to attend events in person may be denied entry without refund.
7. Content Ownership and License
You retain ownership of content you upload, including photos, bios, cosplay information, and profile materials. By uploading content, you represent that you have the rights to share it, and you grant Silverback Events LLC a non-exclusive, worldwide, royalty-free license to display, reproduce, modify for formatting, distribute, and archive that content for purposes related to operating, promoting, moderating, and improving KimoKawaii. You are responsible for the content you upload or submit.
8. Intellectual Property
All KimoKawaii names, logos, trademarks, branding, graphics, website content, event names, promotional materials, designs, text, photographs, videos, and other original content created by or for Silverback Events LLC are the property of Silverback Events LLC or their respective owners and are protected by applicable intellectual property laws. Nothing in these Terms grants permission to copy, reproduce, distribute, modify, publish, display, or commercially use any KimoKawaii intellectual property without prior written permission from Silverback Events LLC.
9. Tickets, Refunds, and Event Changes
All sales are final. Tickets, vendor booths, artist spaces, sponsorships, exhibitor booths, table purchases, and any other event-related purchases are non-refundable and non-transferable, except where required by applicable law or expressly approved in writing by Silverback Events LLC.
KimoKawaii events are held rain or shine. If an event is canceled, postponed, rescheduled, or cannot take place due to circumstances beyond the reasonable control of Silverback Events LLC, including but not limited to severe weather, natural disasters, public health emergencies, government orders, venue closures, acts of terrorism, civil unrest, labor disputes, utility failures, or other force majeure events, refunds will not be issued.
At its sole discretion, Silverback Events LLC may offer purchasers the option to transfer their admission or participation to a rescheduled KimoKawaii event or provide event credit toward a future KimoKawaii event. Any such credit or transfer is provided solely at the discretion of Silverback Events LLC and does not create an obligation to offer refunds, credits, or transfers for future events or circumstances.
10. Consent to Photography, Video, and Media
By attending KimoKawaii, entering event areas, purchasing admission, accepting a complimentary pass, volunteering, appearing as a guest, vending, sponsoring, or otherwise participating, you understand that you may be photographed, filmed, recorded, or livestreamed. You grant Silverback Events LLC and KimoKawaii permission to use your image, likeness, voice, costume, and participation in event photography, video, social media, advertising, livestreams, promotional material, and future marketing without compensation or additional notice. For minors, the parent or legal guardian grants this permission on the minor's behalf.
Attendees may take personal photos and videos unless otherwise posted. Commercial filming, press coverage, influencer shoots, interviews, livestreaming, or professional production require written approval from KimoKawaii.
11. Costume Props, Weapons, and Prohibited Items
No real weapons are allowed at KimoKawaii. All bags, props, and costumes may be inspected by security or event staff. KimoKawaii may deny entry or require removal of any item considered unsafe.
Prohibited items include firearms, guns, ammunition, or realistic firearm replicas; knives, bladed weapons, or items with dangerous points or edges; airsoft guns, BB guns, pellet guns, or items with combustion capability; explosives, fireworks, smoke devices, hazardous materials, or dangerous chemicals; outside alcohol, illegal substances, and outside food or drinks unless medically necessary or approved.
Approved costume props must be safe, non-functional, and inspected when required. KimoKawaii reserves the right to approve, deny, tag, remove, or require modification of any prop or costume at any time.
12. Dress Code and Adult Content
KimoKawaii is a family-friendly event. Costumes must cover areas normally covered by a standard bathing suit. Flashing, mooning, exposed genitals, and sexually explicit public behavior are not allowed. Clothing, signs, props, booth displays, and merchandise visible to the public must be appropriate for a family-friendly environment. Adult material may only be displayed or sold by approved vendors or artists in compliance with event rules, must be clearly labeled, kept out of public view, and shown or sold only to adults with valid photo ID. KimoKawaii may require removal, covering, relocation, or modification of any content, costume, display, or merchandise.
13. Vendors, Artists, and Sponsors
Vendors and artists are responsible for complying with all applicable federal, state, and local laws, including copyright, trademark, sales tax, product safety, and licensing laws. Silverback Events LLC does not verify or guarantee that vendor merchandise is licensed, authorized, or legally compliant. Vendors and artists accept full responsibility for the items they display, promote, or sell.
Unlicensed, counterfeit, pirated, bootleg, stolen, illegal, unsafe, or prohibited items may not be sold. KimoKawaii may require removal of any item and may revoke vendor participation without refund. Vendors and artists agree to indemnify and hold harmless Silverback Events LLC, KimoKawaii, its owners, staff, contractors, volunteers, affiliates, venue partners, and representatives from claims arising from their merchandise, conduct, displays, sales, or participation.
Food and beverage sales are not permitted unless specifically approved in writing by KimoKawaii and the venue. No unauthorized handouts, flyers, QR promotions, samples, solicitations, fundraising, or promotional activity are allowed inside or outside official event areas without written approval.
14. AI Art and Creative Integrity
KimoKawaii was founded by a working artist and exists to support real human creativity. AI-generated artwork may not be sold, exhibited, displayed, or represented as original artist work in Artist Alley, vendor spaces, contests, exhibitions, or official creative areas without written approval from KimoKawaii. Artists and vendors may not misrepresent AI-generated work as hand-created, human-made, or original artwork. KimoKawaii may use AI-assisted tools for operational support including writing assistance, scheduling, editing, content organization, or workflow efficiency. These tools support operations and do not replace artists or devalue human creative labor. KimoKawaii reserves the right to remove AI-generated merchandise or displays and revoke participation without refund for violations.
15. Assumption of Risk and Limitation of Liability
Attendance and participation involve normal risks including crowds, walking, costumes, props, vendor displays, photography, event activities, illness exposure, personal property loss, and actions of other attendees. By attending or participating, you agree to follow event rules, act responsibly, and assume ordinary risks associated with public events.
To the fullest extent allowed by law, you release Silverback Events LLC, KimoKawaii, its owners, officers, employees, contractors, volunteers, sponsors, guests, affiliates, venue partners, and representatives from claims arising from your attendance, participation, conduct, property, merchandise, content, or violation of these policies, except where such release is prohibited by law. The KimoKawaii platform is provided as-is. Silverback Events LLC is not liable for data loss, service interruptions, or third-party conduct. You are responsible for your own property. KimoKawaii is not responsible for lost, stolen, or damaged items.
16. Disclaimer of Warranties
The KimoKawaii website, member platform, events, online services, and related features are provided on an "as is" and "as available" basis. Silverback Events LLC makes no representations or warranties, express or implied, regarding the availability, reliability, accuracy, security, or uninterrupted operation of the website, platform, or services. We reserve the right to modify, suspend, discontinue, or update any feature, service, event, or functionality at any time without liability.
17. Reservation of Rights
Silverback Events LLC reserves all rights not expressly granted under these Terms of Use. KimoKawaii reserves the right to interpret, enforce, modify, or apply these Terms and all event policies as necessary to maintain a safe, welcoming, family-friendly, and enjoyable environment. Decisions regarding admission, participation, moderation, content removal, account restrictions, event operations, and policy enforcement are made at the sole discretion of KimoKawaii and Silverback Events LLC.
18. Governing Law
These terms are governed by the laws of the State of Texas. Any dispute arising from KimoKawaii, Silverback Events LLC, the website, platform, tickets, vendor participation, or event attendance shall be handled in the courts of Montgomery County, Texas, unless otherwise required by law.
19. Policy Changes
KimoKawaii may update these terms at any time. Updated terms may be posted on kimokawaii.net or provided through the platform. Continued use of the website, platform, or event participation after updates means you accept the updated terms.

These Terms of Use should be read together with the KimoKawaii Privacy Policy, Code of Conduct, Vendor Policies, Props Policy, Dress Code, Cosplay Contest Rules, and any additional event-specific policies published by Silverback Events LLC.
