Artist & Exhibitor Guidelines

These guidelines keep the vendor hall and artist alley fair, safe, and family-friendly for everyone. They apply to all artists, crafters, and exhibitors.

Welcome to KimoKawaii Anime Experience & Convention!

These Artist & Exhibitor Policies apply to all KimoKawaii events, conventions, expos, pop-up events, and affiliated activities, regardless of location, unless otherwise stated in writing.

For the purposes of these policies, Artist & Exhibitor includes artists, vendors, exhibitors, sponsors, authors, creators, businesses, organizations, food vendors, and any individual or company approved to participate in a KimoKawaii event.

By submitting an application, purchasing booth space, or participating in a KimoKawaii event, you acknowledge that you have read, understood, and agree to comply with these policies, the KimoKawaii Code of Conduct, all venue rules, and all applicable federal, state, and local laws.

Certain venues or event locations may have additional requirements or restrictions. Any event-specific policies will supplement these general policies and will be communicated prior to the event.

KimoKawaii reserves the right to interpret, modify, or update these policies at any time. Continued participation in a KimoKawaii event constitutes acceptance of the most current version of these policies.

Payment & Acceptance

Artist & Exhibitors may secure their booth space by submitting payment. However, KimoKawaii reserves the right to revoke acceptance prior to the event if merchandise or artwork does not comply with our policies, is inconsistent with our family-friendly environment, or if significant duplication of products would negatively impact the variety of the event. In the unlikely event that acceptance is revoked by KimoKawaii prior to the event, the Artist & Exhibitor will be notified promptly and will receive a full refund of all booth fees paid.

Booth Assignments

Booth and table assignments are determined exclusively by KimoKawaii.

Artist & Exhibitors may not:

Merchandise displayed and sold should generally reflect the products approved during the application process. Significant changes may require additional approval.

Merchandise & Intellectual Property

Artist & Exhibitors are solely responsible for ensuring that all merchandise complies with applicable copyright, trademark, patent, and intellectual property laws. KimoKawaii does not verify licensing rights and assumes no responsibility for determining the legality of merchandise offered for sale. Artist & Exhibitors affirm that they possess all necessary rights, licenses, or permissions required to display and sell their merchandise and accept full legal responsibility for the products they offer.

The following items are prohibited:

KimoKawaii reserves the right to require the immediate removal of any merchandise determined to violate these policies and may revoke participation without refund. Artist & Exhibitors agree to indemnify and hold harmless Silverback Events LLC, KimoKawaii Anime Experience & Convention, its owners, employees, volunteers, contractors, affiliates, venues, and partners from any claims, damages, liabilities, or legal actions arising from the display or sale of their merchandise.

AI-Generated Artwork

KimoKawaii was founded by a traditional working artist and is committed to supporting artists, creators, and the creative community. Our Artist Alley and exhibitor spaces are intended to celebrate original, human-made work and provide meaningful opportunities for artists to share and sell their creations. For this reason, artwork that is substantially generated by artificial intelligence (AI) may not be sold, exhibited, or represented as original human-created artwork at any KimoKawaii event. This policy is intended to protect and celebrate artists who create through their own skill, creativity, and personal expression. KimoKawaii recognizes that AI-assisted tools have become part of many creative and business workflows. The use of AI to assist with tasks such as editing, writing, scheduling, marketing, or administrative functions is not prohibited. However, artwork that is primarily generated by AI image generation systems is not permitted for sale or exhibition. KimoKawaii reserves the right to request additional information regarding artwork if concerns arise and may require the removal of any artwork or merchandise that does not comply with this policy. Failure to comply may result in removal from the event without refund.

Family-Friendly Content

KimoKawaii is a family-friendly event.
All publicly visible displays must be appropriate for a general audience.
Adult-oriented merchandise:

KimoKawaii reserves the right to require any display or merchandise to be covered or removed.

Setup & Teardown

Artist & Exhibitors must check in during their assigned setup window.
Displays must remain entirely within the assigned booth space and may not obstruct aisles, exits, emergency access routes, or neighboring exhibitors.
Early teardown is prohibited unless approved by event management.
At the conclusion of the event, Artist & Exhibitors are responsible for:

Electricity & Safety

Electricity may be available at select events and must be requested in advance when applicable. All electrical cords and equipment must be safely secured to prevent trip hazards. Nothing may be attached to venue walls, ceilings, doors, windows, floors, or fixtures unless specifically authorized by the venue. Artist & Exhibitors must comply with all fire codes and venue safety regulations.

Food & Beverage Vendors

Food and beverage sales may be permitted at select KimoKawaii events depending on venue policies and requirements. Some venues allow approved food and beverage vendors, while others may restrict or prohibit food and beverage sales. All food and beverage vendors must receive prior written approval from KimoKawaii and comply with all applicable venue policies, health department regulations, licensing requirements, permits, and local laws.

Taxes & Licensing

Artist & Exhibitors are solely responsible for collecting, reporting, and remitting all applicable taxes and for obtaining any licenses, permits, certificates, or approvals required by federal, state, or local law. KimoKawaii does not collect, report, or remit taxes on behalf of Artist & Exhibitors unless otherwise required by law.

Security & Insurance

Artist & Exhibitors are solely responsible for securing their merchandise, equipment, cash, electronics, and personal belongings. While event staff may monitor exhibit areas, KimoKawaii cannot guarantee the security of any property. KimoKawaii, Silverback Events, venue partners, staff, volunteers, and affiliates are not responsible for theft, loss, damage, weather, power interruptions, internet outages, accidents, or the actions of other participants or attendees. Artist & Exhibitors are encouraged to maintain appropriate business liability and property insurance.

No Guarantee of Sales

Participation in a KimoKawaii event does not guarantee attendance numbers, customer traffic, sales volume, media exposure, or financial success. Artist & Exhibitors participate at their own discretion and acknowledge that sales results may vary based on many factors outside of KimoKawaii's control.

Independent Participation

Artist & Exhibitors participate as independent individuals, businesses, or organizations. Participation in a KimoKawaii event does not create an employment relationship, partnership, agency relationship, or affiliation between the Artist & Exhibitor and KimoKawaii or Silverback Events. Artist & Exhibitors are solely responsible for their own business operations, employees, representatives, merchandise, taxes, licenses, and obligations.

Compliance with Laws

Artist & Exhibitors are responsible for complying with all applicable federal, state, and local laws, regulations, licensing requirements, tax obligations, and venue policies related to their participation.

Health & Safety

Artist & Exhibitors must comply with all applicable health, sanitation, fire, occupancy, and safety requirements established by the venue, local authorities, and KimoKawaii event management. Displays, equipment, activities, or merchandise that create a safety concern may be required to be modified, removed, or discontinued.

Use of KimoKawaii Name, Logo & Branding

The KimoKawaii name, logos, artwork, branding, and associated intellectual property are owned by KimoKawaii and/or Silverback Events LLC. Artist & Exhibitors may identify themselves as participants of a KimoKawaii event but may not imply official sponsorship, endorsement, partnership, or affiliation without prior written approval.
The use of KimoKawaii branding, logos, promotional materials, or trademarks on merchandise, advertising, websites, or social media requires prior authorization.

Chargebacks & Payment Disputes

Submitting an application and payment for booth space confirms acceptance of these policies. Initiating a chargeback or payment dispute for a booth, table, or participation fee may result in removal from current or future KimoKawaii events and may be subject to additional action where permitted by law.

Refunds

This refund policy applies to all attendees, vendors, artists & sponsors. KimoKawaii Anime Experience & Convention will be open no matter rain, snow, or shine. ALL SALES ARE FINAL. In the event of a mandatory cancellation due to circumstances beyond KimoKawaii's reasonable control, KimoKawaii reserves the right to determine the appropriate resolution. Available options may include a credit toward a future event, transfer to a rescheduled event, or another accommodation determined by KimoKawaii. FOR ALL VENDORS/ARTISTS or anyone who purchased space to participate at KimoKawaii. Please note that any purchased space is non refundable and non transferable.

Abandoned Property

Artist & Exhibitors are responsible for removing all merchandise, displays, equipment, and personal belongings at the conclusion of the event. Any property left behind after the designated move-out period may be considered abandoned and may be removed, stored, donated, recycled, or disposed of at the discretion of KimoKawaii or the venue. Any costs associated with abandoned property may be the responsibility of the Artist & Exhibitor.

Damage to Venue

Artist & Exhibitors are responsible for any damage caused by themselves, their employees, representatives, contractors, or guests to the venue, venue property, or the property of other participants. Any repair or replacement costs resulting from such damage shall be the responsibility of the Artist & Exhibitor.

Photography & Video Release

By participating in a KimoKawaii event, Artist & Exhibitors grant KimoKawaii Anime Experience and Silverback Events LLC the perpetual, worldwide, royalty-free right to photograph, record, and use images, video, audio, booth displays, logos, merchandise, and likenesses for promotional, educational, editorial, archival, and marketing purposes in any media now known or later developed. No compensation shall be owed for such use.

Professional Conduct

Artist & Exhibitors must comply with the KimoKawaii Code of Conduct. Unprofessional, unsafe, disruptive, threatening, discriminatory, or abusive behavior may result in immediate removal without refund.

Force Majeure

KimoKawaii will not be liable for any delay, cancellation, postponement, or failure to perform due to circumstances beyond its reasonable control, including but not limited to natural disasters, severe weather, governmental orders, public health emergencies, venue closures, civil unrest, labor disputes, utility failures, or other unforeseen events.

In the event a KimoKawaii event is affected by a force majeure event, KimoKawaii reserves the right to determine the appropriate course of action based on the circumstances and will communicate any updates or available options to participating Artist & Exhibitors as soon as reasonably possible. Available options may include transferring participation to a rescheduled event, providing credit toward a future KimoKawaii event, or another solution determined by KimoKawaii based on the circumstances.

Termination, Refusal & Enforcement

KimoKawaii is committed to providing a safe, welcoming, and enjoyable experience for all attendees, artists, exhibitors, vendors, guests, volunteers, staff, and venue partners. KimoKawaii reserves the right, at its sole discretion, to refuse, revoke, suspend, or terminate an Artist & Exhibitor's participation before or during an event; relocate booth assignments when necessary; require the removal of merchandise or displays; or deny participation in current or future KimoKawaii events if participation is determined to be unsafe, unlawful, disruptive, inconsistent with these policies, the KimoKawaii Code of Conduct, venue rules, or otherwise negatively impacts the event experience. Failure to comply with these policies, venue requirements, or directions from KimoKawaii staff may result in immediate removal from the event without refund.

These policies constitute the complete participation agreement between KimoKawaii and the Artist & Exhibitor unless otherwise agreed to in writing.
